1. Acceptance of Terms

By downloading, installing, or using the Local Shopping Android application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

We reserve the right to modify these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

Local Shopping is a hyperlocal e-commerce platform that connects customers with shops in their local area (mohalla, village, city). The App facilitates:

• Browsing products listed by nearby shopkeepers.
• Placing orders and making payments (Cash on Delivery or online via Razorpay).
• Order fulfilment and delivery by local delivery partners.
• Shop and inventory management tools for shopkeepers.

We act as a technology platform connecting buyers, sellers, and delivery partners. We are not a party to the transaction between customers and shopkeepers.

3. User Accounts and Eligibility

To use the App, you must:

• Be at least 13 years of age.
• Sign in with a valid Google account.
• Provide accurate profile information including name, phone number, and delivery address.

User roles (Customer, Shopkeeper, Delivery Partner) are assigned by platform administrators. You may not claim a role you are not authorised for.

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

4. Ordering and Payments

• Orders: When you place an order, you make an offer to purchase from the shopkeeper. The order is confirmed when the shopkeeper accepts it.
• Pricing: Product prices are set by shopkeepers. Local Shopping does not control pricing. Prices are displayed in Indian Rupees (INR).
• Cash on Delivery (COD): Payment is made in cash to the delivery partner upon receipt of your order.
• Online Payment: Processed securely through Razorpay. By using online payment, you also agree to Razorpay's Terms of Service.
• Cancellations: Orders may be cancelled by the shopkeeper if items are unavailable. Customers may cancel before the shopkeeper accepts the order.
• Refunds: For online payments, refunds for cancelled or undelivered orders will be processed within 5–7 business days to the original payment method.

5. Shopkeeper Responsibilities

If you are a shopkeeper on our platform, you agree to:

• List only products that you are legally authorised to sell.
• Ensure product descriptions, images, and prices are accurate and not misleading.
• Fulfil accepted orders promptly and in good faith.
• Not list products that are prohibited by law, including but not limited to controlled substances, counterfeit goods, or items restricted under Indian law.
• Maintain adequate stock for listed products or update availability in a timely manner.

6. Delivery Partners

Delivery partners are independent individuals, not employees of Local Shopping. By acting as a delivery partner, you agree to:

• Deliver orders promptly and handle items with care.
• Complete OTP-verified handoffs for every delivery.
• Comply with all applicable laws including traffic regulations during delivery.

Local Shopping is not liable for any accidents, losses, or damages that occur during delivery.

7. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Impersonate any person or entity or misrepresent your affiliation.
• Interfere with or disrupt the App's infrastructure or servers.
• Attempt to gain unauthorised access to any part of the App or other users' accounts.
• Post false, misleading, or fraudulent product listings or reviews.
• Use automated scripts or bots to access the App.

8. Intellectual Property

All content within the App, including but not limited to text, graphics, logos, and software, is the property of Local Shopping or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

Product images uploaded by shopkeepers remain the property of the shopkeeper. By uploading images, shopkeepers grant Local Shopping a non-exclusive licence to display those images within the App.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or free from viruses.
• Products listed by shopkeepers are of merchantable quality or fit for a particular purpose.
• Delivery timelines will always be met.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Local Shopping shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of profits, data, or goodwill.

Our total liability for any claim arising from your use of the App shall not exceed the amount you paid for the specific order giving rise to the claim.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in India.

12. Termination

We reserve the right to suspend or terminate your account at our discretion, without notice, if we believe you have violated these Terms or engaged in fraudulent or harmful behaviour. You may delete your account at any time by contacting us.
